The DOJ "went after police and fire departments for using standard aptitude tests in the hiring process." There was “no evidence of intentional discrimination — only statistical disparities” but the Biden administration “branded the aptitude tests at issue in these cases as discriminatory in an effort to advance a DEI agenda.”   For example, "the Maryland State Police were accused of “illegally discriminating against Black applicants and women” because the Civil Rights Division concluded that “Black applicants passed the test less often than White applicants and because women passed the physical test less often than men.”   "Similar lawsuits were brought against the jurisdictions of South Bend, Indiana, and Cobb County, Georgia, according to Fox News. Brentwood Union Free School District in NY changed the name of a school mascot from the Indians to the Spartans because its apparently 'racist' to call them the Indians. But apparently calling them the Spartans is 'racist' too AND 'sexist' because the Spartans, 1000s of years ago, had slaves and did not allow women to serve in the military. But the second KJP says she's an independent rather than a democrat, democrats confirm that it was all true and worse. All of a sudden, they admit "she was kinda dumb" and "incoherent." She "was one of the most ineffectual and unprepared people I've ever worked with…She didn't know how to manage a team, didn't know how to shape or deliver a message, and often created more problems than she solved.” And on and on. Oct 19, 2025 ~ 'Trump Pushes Back on Disparate Impact'   Hopefully the scam called 'Disparate Impact' is finally coming to and end with the help of President Trump.   "The story begins with the Civil Rights Act of 1964, one of America’s foundational antidiscrimination laws. The statute’s original text made no mention of disparate impact and explicitly protected employment tests—as long as they were professionally developed and not “designed, intended, or used” to discriminate based on illegitimate criteria such as race."   "However, in a series of decisions beginning with 1971’s Griggs v. Duke Power, the Supreme Court ruled that professionally developed tests (and other selection mechanisms) could still be considered illegal discrimination, even without any intent to discriminate. Congress later codified this interpretation in the 1991 Civil Rights Act, explicitly authorizing the courts to apply the disparate-impact framework."   Following that Act, any test or requirement that negatively affected one race more than others would be deemed 'racist' by definition and would have to be changed. This is how the banking industry was deemed 'racist' because by treating all races equally by looking at relevant measures such as credit score and income, more black people were excluded than white people. The qualifications were not racist but it didn't matter. Banks had to 'remedy' the 'racism' by lowering the standards for black people to up the numbers. The collateral damage that resulted (black families going bankrupt, banks going under) did not matter to the race hustlers.   Disparate impact effected many other areas than banking. Tests to become firefighters were called 'racist' because not enough black people were meeting the minimum requirements in some areas. The tests were not racist; they tested for important job relevant things like calculating how many hoses were needed to cover a distance. SAT tests were called 'racist' for the same reason. Many colleges were forced start ignoring or downplaying SAT scores so as not to run afoul of disparate impact claims.   Everyone started implementing illegal racial quotas as the only way to fight off disparate impact claims: "It’s hard for a department to avoid lawsuits and liability proactively, given the subjectivity involved both within the executive branch and in the courts. 'The only way they are going to avoid trouble with a liberal Justice Department is if they ensure that at the end of the year, when you break down their hiring, it fits the racial quotas that the Justice Department thinks you ought to have.'"   Physical tests have a disparate impact on women which put fire stations and other jobs between a rock and a hard place. They must ensure that their people are physically able to do the job for the safety of everyone involved, but they also must make sure their hiring has no disparate impact.
